Summary

Ofgem determines the basis of selection for the Code Manager for the Balancing and Settlement Code (BSC). Sets out whether the role goes by default to the incumbent (Elexon) or via competitive process.

Under new powers created by the Energy Act 2023 , we will be responsible for selecting code managers on either a competitive or non-competitive basis, leading to the potential grant of a code manager licence. Each code manager will be responsible for the governance of its respective designated code, which they will be obligated to do in an independent and impartial manner. They will also be responsible for facilitating the development of the codes in line with the policy priorities set out in our annual Strategic Direction Statement. This determination sets out the decision of the Authority, under section 187(1) of the Energy Act 2023, to proceed with the selection of a code manager for the Balancing and Settlement Code on a non-competitive basis. Following this determination, Elexon Ltd will be invited to submit a licensing assessment form. We will then consider this information and publish a notice stating whether we propose to grant it a licence.
